FL: Sebastian lifts mask mandate for grocery stores, food services and other businesses

SEBASTIAN—Business owners will no longer be cited if they and their employees don’t wear masks to help slow down the spread of COVID-19.

At their meeting Wednesday, City Council members voted unanimously to lift the requirement that all people wear masks who work in Sebastian grocery stores, food service, salons, gyms, retail establishments or businesses open to the public where social distancing is not possible.

Instead, the city will leave the decision up to business owners to decide whether masks are required for staff and customers in their businesses.

Vice Mayor Jim Hill said since Gov. Ron DeSantis moved Florida to a Phase 3 reopening status, the city would no longer have any authority to fine any business that did not comply with the mask mandate it adopted July 1.

“I do not believe any government should have a law in place that cannot be enforced,” said Hill. “For me, the ordinance is irrelevant. If we don’t have an enforceable ordinance, we should not have it in place.”

Councilman Bob McPartlan said he is concerned about the spread of COVID-19, something he deals with in his job as an administrator for the Florida Department of Children and Families.

There are people who are dying out there,” said McPartlan. “But I do think it should be up to the individual what they want to do. You can’t legislate good behavior.”

Mayor Ed Dodd, who acknowledged he lost his brother to COVID-19, was hesitant to lift the mandate. However, he voted in favor of ending the mandate, saying it was a hesitant yes.

“What we’re saying here is we are rescinding the requirement that people who work in restaurants, grocery stores, food service, etc. wear a mask,” said Dodd. “It is up to the individual business to decide that; however, we are still strongly recommending that people wear masks.”

But if residents need to visit offices at city hall, they will still be required to wear masks, as will city employees.

“We are continuing to say if you enter city hall, you have to wear a mask,” said Dodd.

In other business, the City Council re-elected Dodd to serve another term as the city’s mayor. Dodd was first elected to the position in 2019.

Hill, who became vice mayor when Charles Mauti was recalled from office, will continue to serve in that capacity.
